How do I know if I have a serious injury?We are often asked by clients whether they have a "Serious Injury". The term is constantly being examined by judges, and a recent decision by the Court of Appeal in Victoria has helped to make the concept easier for an injured person to understand.
In Hayden (2010), the Court focused on the level of pain perceived by the injured person and how that pain affected a persons life. Pain alone can be the basis for a Court to find you have suffered a "Serious Injury".
